MEMORANDUM OPINION

LAMBERTH, District Judge.

This matter comes before the Court on defendants’ motions to dismiss several counts of plaintiffs’ first amended complaint and for summary judgment on plaintiffs’ ■ NEPA claim, as well as plaintiffs’ cross-motion for summary judgment on the NEPA claim. The underlying issue is the legality of the Department of the Interior’s decision to enter into a novel agreement that allows a private biotechnology company to “bioprospect” microbial organisms from geysers and other thermal features in Yellowstone National Park.
