I. INTRODUCTION

This matter is before the Court on the United States of America’s (“the government’s”) civil action against defendant Midwest Suspension and Brake (“defendant” or “Midwest”) under § 113 of the Clean Air Act, 42 U.S.C. § 7413, 1 for alleged violations of § 112 of the Clean Air Act, 42 U.S.C. § 7412, the National Emission Standards for Hazardous Air Pollutants for Asbestos, 40 C.F.R.
