This suit involves a civil action by the United States Environmental Protection Agency (the “EPA”) against two defendants for violations of sections 112 and 114 of the Clean Air Act (the “Act”), 42 U.S.C. §§ 7412(c) and 7414, and the National Emissions Standards for Hazardous Air Pollutants for Asbestos (the asbestos “NESHAP”), 40 C.F.R.
