The defendant was charged with the crime of grand larceny, third degree, in violation of Penal Law § 155.30 (4), for the theft of two credit cards. At the close of the People’s case, pursuant to CPL 290.10 (1), the defendant moved for a trial order of dismissal, upon the ground that the People had failed to prove that the credit cards were valid and unexpired; that application was denied.
