The defendant was indicted, tried and convicted of criminally carrying and possessing a weapon commonly known as a blackjack, after previously having been convicted of the crime of unlawfully possessing a firearm, under the provisions of section 1897 of the Penal Law (as amd. by Laws of 1921, chap. 297)' providing as follows: “A person who attempts to use against another, or who carries, or possesses any instrument or weapon of the kind commonly known as a blackjack, slungshot, billy, sand club, sandbag, metal knuckles, bludgeon, or who, with intent to use the *645same unlawfully…
