Appellant attacks the holding of this court in Hantz v. State (1929), 166 N. E. (Ind. App.) 439, and says it establishes a “new doctrine in Indiana,” not supported by reason or authority, and, in addition to the two Kentucky cases mentioned in that case, he cites Gildrie v.
