The issue in this certified appeal is whether a defendant charged with the operation of a motor vehicle while his license is under suspension in violation of General Statutes (Rev. to 1995) § 14-215 (c)1 (driving under suspension) has the burden of persuasion regarding whether he was operating his motor vehicle within the scope of a special operator’s permit (work permit) issued pursuant to General Statutes (Rev. to 1995) § 14-37a.2 The defendant, Stanley T.
