Plaintiff commenced this action individually and on behalf of others similarly situated alleging violations of the Telephone Consumer Protection Act, 47 U.S.C. § 227(b)(1)(C), and regulation 47 C.F.R. § 64.1200(a)(3), promulgated thereunder (hereinafter referred to collectively as “TCPA”). Before this Court are defendant’s motion to dismiss for lack of subject-matter jurisdiction and plaintiffs motion for class certification.
