This matter is before the Court on an objection filed by Jay G. Lindgren, (“Defendant”) to a Report and Recommendation issued by Magistrate Judge Robert W. Lovegreen. Judge Lovegreen recommended that this Court deny Defendant’s motion to dismiss the Complaint and an alternative motion to vacate an existing Consent Decree.
