Of the thirty-six reasons of appeal, the first and clearly the most important raises the question whether the power of appointment given Mrs. Miller by the third clause of Darius Miller’s will was duly exercised by the provisions of her will. This is correctly stated by counsel for the appellants as the “ultimate issue” in the case.
