OPINION

MILLER, Judge.

This case is before the court on defendant’s motion for summary judgment and plaintiffs’ cross-motion for partial summary judgment on liability. Plaintiffs are numerous business-entity property owners that entered into mortgage contracts with the Government in exchange for providing low- and moderate-income housing. These mortgage contracts originally allowed prepayment; however, a subsequent Act of Congress delayed and restricted the right to prepay the mortgages.
