This matter is before the court on the motion of defendant Midland Funding, LLC, to Stay and to Compel Arbitration, or Alternatively, to Dismiss in Favor of Arbitration, Filing No. 45.1 This is a putative class action for violations of the Fair Debt Collections Practices Act (“FDCPA”), 15 U.S.C. § 1692.
