The Plaintiff, Darwin National Assurance. Co. (hereinafter “Darwin” or “Plaintiff’), filed the above-captioned declaratory judgment action pursuant to the Federal Declaratory Judgment Act, 28 U.S.C. § 2201, and Fed.R.Civ.P. 57 on May. 15, 2013. (Doc. # 1).
