Plaintiff Nelson Beers brought this suit against the defendant Audrey Beers, as administratrix of the estate of Clifford Beers, deceased, to establish the fact that the plaintiff and his deceased brother Clifford Beers had entered into a farming partnership, and to determine that 160 acres of land standing in the name of the deceased brother, certain personal property used in the farming operations, and the income resulting from the logging of a portion of the land were partnership property.
