Plaintiff, a remainderman under an inter vivos trust, brought this action for damages resulting from a breach of trust by defendant bank, as trustee. After trial to the court, plaintiff prevailed. On appeal, defendant assigns error to (1) the overruling of its demurrer based on the nonjoinder of other beneficiaries of the trust as indispensable parties to the action; (2) the finding that defendant breached its fiduciary duty to plaintiff as a remainderman under the trust in the sale of the sole trust asset, stock of Staff Jennings, Inc.; (3) the award of damages, in any amount, or, in the…
