The complaint in this action alleges that, at the special instance and request of the defendants, the plaintiff performed certain services, to wit: sold one hundred and seventy-five thousand shares of the Cat Canyon Oil Company; that defendants promised to pay plaintiff four thousand five hundred dollars for such services so rendered; that upon request they have refused to pay the same or any part thereof, and judgment is asked for that amount.
