CONMY, District Judge.
Pursuant to the court’s Order of May 8, 1998, this matter is before the court for a determination on the merits of the plaintiffs request for declaratory and injunctive relief.
I. FACTUAL BACKGROUND.
By this action, the plaintiff seeks a determination that the defendant has caused unlicensed radio transmissions to occur in violation of FCC licensing ■ regulations, that the low-power radio transmissions made by the defendant require a license and that the defendant, and “all persons in active concert or participation with [the defendant]” be enjoined from making radio…
