In this action, the appellant sued the appellee, in a complaint of three paragraphs, upon an open account for services rendered by the appellant as a physician, at the instance and request of the coroner of Bartholomew county. The appellee demurred to each paragraph of the complaint, upon the ground that it did not state facts sufficient to constitute a cause of action., which demurrers were overruled, and to these decisions the appellee excepted.
