This appeal is from a Claims Court decision on cross-motions for summary judgment. The four claimants were regular officers of the Army and Navy, retired for length of service and not for disability who, after such retirement, had taken staff positions with the Board of Governors of the Federal Reserve System. The appellee United States, with the support of the General Accounting Office (B-212226, Dec. 16, 1983), had determined that as a matter of law the Dual Compensation Act, 5 U.S.C. § 5531 and ff. as reenacted in 1964, required that the annuities otherwise…
