The plaintiff brought this action on behalf of himself and his assignors to recover for losses which had been sustained by reason of the burglarizing of the safe deposit boxes which the plaintiff and his assignors had leased from the defendant. The cause came on for trial before tbe court and a jury. At tbe conclusion of tbe plaintiff’s evidence, upon tbe motion of tbe defendant, tbe court withdrew tbe case from tbe jury and entered a judgment of dismissal, from wbicb tbe plaintiff appeals.
