The only question presented for determination upon the record is whether the practice of demurring to the evidence is sanctioned by the Constitution and laws of this State-. The suit was *411brought by W.. D. Hopkins, Administrator, to recover damages for the unlawful killing of his son, W. O. Hopkins.
