This opinion and order are directed to a motion to dismiss for lack of subject matter jurisdiction.

On August 3, 1977, the plaintiff (“Local 519”) filed a verified complaint alleging jurisdiction under 28 U.S.C. § 1331 and 49 U.S.C. § 1601 et seq., and a motion for a preliminary injunction ordering defendants (collectively referred to herein as “LaCrosse”) to enter into arbitration of the terms of a new collective bargaining agreement.
