The accused was tried by general court-martial upon the charge of premeditated murder, in violation of *158Article 118, Uniform Code of Military Justice, 10 USC § 918. The court returned findings of guilty of the lesser included offense of unpremeditated murder and sentenced him to dishonorable discharge, total forfeitures, and confinement at hard labor for twenty years. Intervening appellate agencies having affirmed, the accused petitioned this Court for review. The petition was granted so that we might pass on the following issue:
