*11The controlling facts necessary for the determination of this appeal are these: Under the supervision of the State Highway Commissioner and with the proceeds of county bonds issued for the purpose of road construction, the Board of Supervisors of Louisa county were constructing a public highway. It being deemed wise to change the location of the road in many places, it became necessary, if the plan was to be pursued, to condemn a right of way for the road through the property of W. F.
