The defendant in error, as plaintiff, filed suit against the plaintiff in error, as defendant, on June 20, 1917, in the district court of Ottawa county for an accounting and breach of contract and damages in the sum of $10, 000. For convenience the parties will be referred to as they appeared in the trial court. Plaintiff’s petition consists of five paragraphs.
