State v. Arney

Court of Appeals of North Carolina

1Opinion of the Court

PARKER, Judge.

Defendant assigns error to the consolidation for trial of her case with the case against McElveen. The question whether to consolidate was for the sound discretion of the trial judge. *351State v. Wright, 270 N.C. 158, 153 S.E. 2d 883 (1967). Here, the record discloses that the events which gaive rise to the two cases were so connected in time, place and circumstances as to make one continuous criminal episode. Under such circumstances consolidation was proper, State v. Walker, 6 N.C. App. 447, 170 S.E. 2d 627 (1969), and no abuse of the trial judge’s discretion has been shown.
