Appeal by the defendant from an order denying his motion for a new trial.
The property in question is desert land. Plaintiff sued in ejectment alleging that she was in possession from February 1, 1906, until about November 8, 1906, when she was ousted by defendant. The answer denied plaintiff’s actual possession. Neither appellant nor respondent relied upon a paper title.
