Presently before the Court for determination is defendant’s motion for a summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure. First, this Court finds that there are no material facts at issue. Plaintiff is the *1198administratrix of the estate of Marshall Wilson who was fatally injured in an automobile accident on the morning of July 10, 1967.
