This is an appeal from a judgment in the sum of $1,000 rendered in the district court of Oklahoma county in favor of Anna R. Tidwell, defendant in error, against the Prudential Insurance Company, plaintiff in error herein.

For the purpose of convenience we will refer to the parties as they appeared in the trial court. On November 15, 1928, this action was commenced in the district court of Oklahoma county by Anna R. Tid-well as 'beneficiary1 under a life insurance policy in' which her deceased husband, Ralph 'D. Tidwell, was the insured and the defendant was the insurer. The policy was for the…
