Defendant in error, Mrs. Ida C. Handley, sued plaintiff in error, United Fidelity Life Insurance Company, to recover under an insurance policy on the life of her husband, M. L. Handley. She obtained a recovery in the district court and the judgment was affirmed by the Court of Civil Appeals. 53 S. W. (2d) 833. The only question for decision here is whether or not there was actually a contract of insurance upon the life of M. L. Handley at the time of his death. There is no dispute as to the material facts.
