Respondent, Mrs. Ruth A. Hall, sued petitioner, Republic National Life Insurance Company, as alleged insurer, for respondent’s benefit, of the life of her husband, George W. Hall, who was killed in an airplane accident on April 10, 1949, in Wyoming. The petitioner company denied the existence of an insurance contract on several grounds, one of which was that • there had been no agreement as to the essential matter of the premium rate.
