The appellee, as the widow of M. L. Hand-ley, instituted this suit against appellant insurance company to. recover upon a policy of life insurance which she alleges had been issued to her husband.
She alleges that on September 29, 1931, the local agent of the company mailed his check, drawn for the amount of the premium, to the company; that on September 30, 1931, her husband was killed, and that some time during the same day the policy sued upon was filled in and signed by an officer of the company, but was never actually mailed to or delivered to M.
