Main, J. —

The plaintiff, a registered pharmacist and the operator of a drug- store in this state, brought this action as a citizen and taxpayer for the purpose of securing an injunction against the defendants prohibiting’ them from carrying- out the provisions of chapter 62, Laws of 1933, Ex. Ses., p. 173 (Rem. 1934 Sup., §7306-1 et seq.), for the alleged reason that the act was unconstitutional. To the complaint, a demurrer was interposed and sustained.
