This action comes before this Court on the Motion of the defendant, Henry I. Gilbert, filed pursuant to Rule 12(b) of the Federal Rules of Civil Procedure, 28 U.S.C.A., to dismiss the action.

The case involves an action for money loaned brought against the defendant, Henry I. Gilbert, a resident of the State of New York, by the plaintiff, Jack Westerman, a resident of the State of Rhode Island.
