FACTS AND PROCEDURAL BACKGROUND

In January, 1990, Appellee, Wanda Land-rum, and her husband William Landrum, brought suit against defendants Dehaan Greenhouses, and Rollins Leasing Corporation, for damages arising from a personal injury Mrs. Landrum had sustained. Mr. Landrum’s claim was based on loss of consortium, and is not material to the issues before us today. Mrs. Landrum was injured while worMng for Wal-Mart Stores, Inc., and had earlier received workers’ compensation, which was paid by Appellant, National Union Insurance Company, Wal-Mart’s workers’ compensation insurer.
