—Judgment unanimously affirmed. Memorandum: After a joint trial with a codefendant, defendant was convicted of murder in the second degree (Penal Law § 125.25 [3] [felony murder]) and burglary in the first degree (Penal Law § 140.30 [2]). Codefendant was convicted of intentional murder (Penal Law § 125.25 [1]), felony murder and burglary in the first degree and, when his appeal came before us, that judgment of conviction was affirmed (People v Lorenzo, 224 AD2d 924, lv denied 88 NY2d 967). The charges stem from the murder of the victim during the burglary of her home in the City of Tonawanda.…
