KLEIN, Justice.

Plaintiff-appellant State of Hawaii (the prosecution) appeals from a circuit court order granting defendant-appellee Martin Richardson’s motion to suppress evidence. For the reasons set forth below, we vacate the circuit court’s order and remand for further proceedings.

I. BACKGROUND
