On September 3, 1907, at Kiowa, Ind. T., the defendant in error Daniel W. Beats gave the plaintiff in error, the Midland Savings & Loan Company, of Denver, Colo., his first mortgage bond or note in the principal sum of $500, and. as part security therefor on said day executed a real estate mortgage on lot numbered 4 in block numbered 63 in the town of Kiowa. According to the terms of said bond, the maker thereof obligated himself to pay or cause to be paid to the said company, at its office in the city of Denver, the sum of $13.25 monthly, on or before the last day of each month, of which sum…
