The parties will be designated hereinafter as they appeared in the trial court, that is, the plaintiffs in erról-as plaintiffs and the defendant in error as defendant.

This action was instituted by the plaintiffs filing their petition in the district court of Grant county, on the 11th day of'March, 1931, and subsequently filing an amended petition.
