NORVELL, Justice.

The controlling question of this 1 litigation is whether or not the “G. Bedell Moore Memorial Fund” is a charitable trust. The property involved is what ■ is known as the Bedell building situated in San Antonio, Texas. By- her will, Mrs. Elizabeth Moore provided that her son, G. Bedell Moore, the plaintiff below and appellant here, should take a life estate in the building, with remainder - over .to the Memorial Fund.
