WILLIAMS, Justice.

Action for declaratory judgment and construction of trust provisions of the holographic will of Bernice E. Atkinson, deceased, relating to certain real property in Kinney County, Texas. (Art. 2524—1, Sec. 2, Vernon’s Ann.Tex.St, and Art. 7425b-24, V.A.T.S.). Bernice E. Atkinson, a resident of California, died December 24th, 1959. Her handwritten will, dated May 8, 1959, was admitted to probate in a Superior Court of California on February 17th, 1960. Inasmuch as a portion of the will related to real property situated in Texas, the will together with the probate proceedings…
