Plaintiff, a six year old boy, through his guardian ad litem, recovered a verdict for personal injuries, and defendant appealed from an order denying its motion for a new trial.

Fourth street in the City of International Falls extends east and west and is crossed at right angles by defendant’s railway tracks, and a flagman is stationed at this crossing.
