This appeal is prosecuted by the plaintiff in error, who was the plaintiff below, John W. Probert, against the defendants in error, who were the defendants below, to reverse the judgment of the district court of Roger Mills county, sustaining the defense interposed by the defendants below, to reverse the judgment of the district court of Roger Mills county sustaining the defense interposed by the defendants against the foreclosure of a certain mortgage upon real estate.
