The defendant is proprietor of a hotel in Sioux City, and for several years the plaintiff had been in his employ as a day clerk, and among other things was charged with the duty of keeping order in the office. He alleges and gives testimony tending to, show that, in the early evening of November 23, 1920, while he was engaged in the performance of such service, he was approached by one Dunwoody, who asked to be assigned to á room.
