Ed B. Mooney sued Street Improvement District No. 113, of Hot Springs, and its commissioners, 1 alleging that he, as the contractor whose bid for making certain improvements was accepted, was given a certificate of indebtedness for $3,000 representing final payment. Seven credits extended from September, 1931, to September, 1937,-aggregating $1,349.50, were set out in the complaint, leaving a balance of $2,836.79 as of October 1, 1937. The certificate bore interest at the rate of six per cent, per annum. It was dated December 14, 1930, and was due a year later. Appellee’s suit was filed’…
