Appellant brought this action against respondent for the recovery of excess payments amounting to $7,874.04, arising out of the claim that respondent had charged appellant’s assignor, the Tidewater Lumber Company, a higher rate, based upon a higher minimum load per car, for transporting its logs a lesser distance on the same line and in the same direction than it had charged the St. Paul & Tacoma Lumber Company, a competitor of the Tidewater Lumber Company, for performing a like and contemporaneous service.
