Plaintiff and appellant Bankers Trust Company (“BTC”) appeals from the grant, of defendant Lee Keeling’s (“Keeling”) Fed. R.Civ.P. 50(b) motion for judgment as a matter of law on BTC’s claim of negligence and negligent misrepresentation in the preparation of certain oil and gas reserve reports, and from the grant of summary judgment for Keeling on BTC’s “alter ego” claim against him.
