This accident occurred early in the morning of June 8, 1945, on the highway leading from the village of Castle-ton to the' City of Rutland. The plaintiff’s intestate was a guest passenger in an automobile driven by the defendant. The issues to be decided are whether the trial court committed error in denying the defendant’s motions to direct a verdict in his favor, and to set aside the verdict rendered for the plaintiff.
