Plaintiff is on appeal to this Court from a decision of the Ingham county circuit court, *653affirming the Michigan employment security appeal board which in turn had affirmed the referee, refusing to uphold plaintiff’s determination that on September 7, 1963, defendants had engaged in a transfer and continuation of business under CLS 1961, § 421.22 (Stat Ann 1960 Eev § 17.524).

Defendant Allied Supermarkets (hereafter designated Allied) operated and leased 3 Wrigley supermarkets in Bay City, and Vescio’s Inc. (Yescio) operated 5 Yescio markets in other areas of Michigan. Defendant Yay Foods, Inc.…
