DAY, District Judge.

In this action the plaintiff, statutory liquidator of The Preferred Accident Insurance Company of New York, seeks a judgment requiring the defendant to account for and pay over to him all monies collected by the defendant as premiums for all policies or other contracts of insurance issued by or in behalf of The Preferred Accident Insurance Company of New York by or through the defendant, his agents, sub-agents, servants and employees together with interest thereon from the date due.
